Terms & Conditions Rental Mediation

1. Definitions

  • Agent: 42ND, registered with the Dutch Chamber of Commerce under number 78687098.

  • Client: the individual who commissions 42ND to provide mediation services for finding rental accommodation.

2. Services

42ND mediates in the conclusion of tenancy agreements between tenants (clients) and landlords of residential properties. 42ND is not a party to the final rental agreement between tenant and landlord.

3. Fees

  • Upon successful mediation, the client owes an agency fee equal to one month's rent excluding VAT, unless agreed otherwise in writing.

  • A non-refundable start-up fee of €250 is payable in advance and will be deducted from the final invoice upon successful mediation.

  • If no suitable property is found within 3 months, the start-up fee will be refunded unless the client terminates the agreement after the first viewing has been scheduled.

4. Provision of Information

The client must provide accurate and complete information (e.g. ID, income, housing situation). 42ND cannot be held liable for damages resulting from inaccurate or incomplete information.

5. Privacy

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). Data will only be shared with third parties when necessary for the performance of the agreement. See our Privacy Policy at www.42nd.eu/privacy.

6. Liability

42ND is not liable for any damages arising from the conclusion or execution of the rental agreement, unless due to intent or gross negligence.

7. Term and Termination

The mediation agreement is valid for three months from the date of signing. Early termination is possible in writing with seven (7) days' notice. The start-up fee will not be refunded after the first viewing has been scheduled.

8. Complaints

Complaints about the service must be submitted in writing within 14 days of discovery. 42ND will respond within 14 working days to resolve the issue.

9. Governing Law

These terms are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam, the Netherlands.
